These general conditions and terms of sale apply without any restriction or reservation whatsoever to contracts for products and services signed by the purchaser and the company Skum Acoustics SLU (Tax Identification Number B65958407), either through the skumacoustics.com website (hereinafter, Skum Acoustics), by telephone, by e-mail or using any other remote contract method existing for that purpose.
The contracting of products and services in Skum Acoustics entails the reading and express and unconditional acceptance by the purchaser of the terms and conditions set out in this contract in the manner in which they were formulated at the time of signing the contract, and express acceptance in relation to the sending by e-mail of the invoice and documentation related to the processing and confirmation of the order, follow-up of the shipment or information with respect to promotions and news on the products and services of Skum Acoustics.
Skum Acoustics reserves the right to make any changes it considers convenient to the general conditions and terms without notice. Such changes may be made using any method admitted by law and must be complied with during the time they remain in the website and in all cases, until they are validly modified by other subsequent changes.
These general terms and conditions will take preference over all other documents that contradict them, without detriment to what is provided for by current legislation or by mutual accord in writing in the application of specific contractual terms and conditions.
This contract is drawn up in the Spanish language.
To place orders in Skum Acoustics, purchasers must register and open a customer account or identify themselves as such in the registration form provided for that purpose in the website.
Purchasers will use the shopping cart available in the website to purchase the article/s they want, using the "Add to cart" option on each product page. After making the product selection, purchasers can access the cart summary by clicking "Purchase now" as the first step in formalising the purchase.
To end the process and formalise the order, purchasers should identify themselves with their customer account data or complete the registration form if they have not yet registered. Then they should select the payment method, transport firm and click the "Finalise purchase" option to confirm the order and establish the payment obligation of the purchaser.
After completing the purchase process, the purchaser will receive an e-mail 'confirming the order' with a list of the products requested, the billing and delivery information and the designated transport firm. Depending on the payment method chosen, the purchase will receive details and additional instructions for processing payment by e-mail.
The order will be considered approved along with the contractual obligation of Skum Acoustics once payment of the same has been confirmed and validated. The purchaser will receive a "Payment confirmed" notification by e-mail indicating that the payment process was successfully completed and the process for preparing and shipping the order will start.
The order status will change to "Shipped" when the transport firm has collected the respective packages from our premises. The purchaser will receive the notification that the order has been shipped and is in transit by e-mail.
PRICES AND TAXES
The product prices are always given in EUROS (€), except UK users in which case they are given in POUNDS STERLING (£). The website also has a free configuration tool in which purchases can select the currency they prefer, EUROS (€ or POUNDS STERLING (£).
- EU residents: the product prices include the applicable V.A.T. (Value-Added Tax) amount. Purchases made by taxpayers residing in the EU duly identified by a valid intra-community VAT number will be exempt from paying V.A.T. as established by article 25 of Act 37/1992 of 28 December which regulates that tax.
- Residents of non-EU member states: purchases made by natural persons or bodies corporate residing in non-EU member states are exempt from V.A.T.
For the purposes of applying the tax, the geographical areas of the Canary Islands, Ceuta and Melilla are considered non-EU territories.
The prices applicable to each product are those posted in the website at the time of acceptance and confirmation of the order, except in the case of errors or omissions in the same.
The selling prices published do not include expenses for shipping the products, and those expenses will be itemised based on the volume and destination, and must be accepted by the purchaser before formalising the order.
The offers available at any given time are clearly identified as such and their validity term will be effective as long as they are posted in the website, indicating the previous price and the price of the offer.
Skum Acoustics reserves the right to change the product prices without notice.
All operations will be made without exception using one of the available payment methods offered to purchasers during the purchase process. Skum Acoustics accepts the following payment methods: credit/transfer to account or payment with credit/debit card.

DELIVERY AND SHIPPING COSTS
Skum Acoustics undertakes to deliver the products in perfect condition to the delivery address indicated by the purchaser in the order form. Nonetheless, Skum Acoustics will not be held responsible for errors or delays in the delivery process due to caused by errors or omissions in the address specified by the purchaser in the order form or cases in which the packages were made available to the purchaser within the agreed term and were not delivered due to causes attributed to the purchaser.
The delivery will be deemed made as soon as the transport firm delivers the packages to the purchaser and the latter signs the delivery note, or if delivery is confirmed by the control system of the transport firm.
The average delivery term for standard shipments by road is 1-3 business days for the Spanish mainland and 3-5 business days for Europe. However the delivery terms may be altered for logistics reasons or due to Force Majeure events in which case the purchaser will be promptly informed of the causes and the new estimated term.
Shipping expenses are calculated depending on the volume and destination of the order; they are added to the total amount of the shopping cart before the order is formalised.

CANCELLATION OF ORDERS
Purchasers may request the cancellation of their order using the contact form available in the website, up to the time before the goods are shipped. Once the order has been shipped ("Shipped" status), the order cannot be cancelled and in this case, a return must be made by exercising the right of withdrawal under the conditions and within the term stipulated by law.
RETURNS / RIGHT OF WITHDRAWAL
Pursuant to current legislation, purchasers have a maximum term of fourteen (14) calendar days from receiving the order to exercise their right to withdraw from the purchase contract. To exercise that right, purchasers should proceed as follows:
- They should identify themselves in skumacoustics.com using their customer credentials.
- They should access their account through "My account" and enter the "Orders log" section.
- They should unfold the details of the order they wish to return.
- They should tick the boxes of the product/s to be returned and confirm the return request or RMA.
Once the request has been accepted, purchasers can download the respective RMA document with the details and instructions for the product return.
- Please return the products within no more than thirty (30) calendar days from the date of requesting the return or the RMA.
- The products should be returned in their original packaging, with no damages, wear or signs of use. Bear in mind that the purchaser is responsible for paying the expenses incurred in the return.
- After receiving the packages, we will evaluate their correct state and refund the amount (products + delivery) within no more than five (5) business days, using the same payment method as the one used to make the original purchase.
Exception to the right of withdrawal:
- No custom products or articles manufactured to the purchaser's specifications will be returned.
FAULTY, DAMAGED OR INCORRECT PRODUCTS
In the exceptional case that a purchaser receives an order with a faulty, damaged or incorrect product, that purchaser should inform us immediately by sending an e-mail to firstname.lastname@example.org, hacienda with the following information:
- Contact data.
- Order number.
- Description of the incident.
Our customer service staff will evaluate the incident and contact the purchaser as soon as possible to resolve the problem. In some cases we will ask the purchaser to send photographs of the faults in order to carry out a more thorough evaluation.
In the event of a purchaser observing damages in the packaging when the packages are delivered, he/she should inform the transport firm and take note of the damages in the transport firm's delivery note.
Pursuant to current legislation, Skum Acoustics SLU will respond for faults in conformity occurring during a period of two (2) years from the delivery date, under the legally-established terms.
In the event of faults in conformity, to ensure the efficacy of the warranty, purchasers should notify us within two (2) months of being aware of the fault by sending an e-mail to email@example.com and attaching their contact data and the number of the original bill of sale.
The warranty does not cover faults or damages caused by external factors, use or incorrect installation or normal wear of the products.

APPLICABLE LEGISLATION AND JURISDICTION
In the event of any dispute arising in relation to the interpretation or enforcement of these general terms and conditions of sale, the Courts responsible for dealing with the matter will be those stipulated by the applicable legislation on competent jurisdiction for dealing with end consumers, in the site where the obligations must be fulfilled or those of the domicile of the purchaser.
In cases in which the purchaser is a professional or a company, the parties shall submit to the Courts of Barcelona (Spain), waiving their right to use any other system that could be open to them.
